O'Brian, an attorney and former head of the War Emergency Division of the Department of Justice during World War I, was running as a Republican against incumbent Democratic Senator Robert F. Wagner. Here he argues that the Wagner Act needed amendment because it was unfair to labor. "I desire to make it as easy as possible for employees to present their complaints informally and inexpensively and to have their complaints quickly disposed of by a fair hearing." He argues that it is the Labor Board that stands in the way of fair play.
